Terms and Conditions of Sale

In this agreement, "you" means the client (the buyer), and "us" means KWR Studio (the seller).

The term, "images" means the edited photographs to be delivered to you by KWR Studio under the terms of the order.

By placing an order with KWR Studio, you express your agreement to these terms.

Tracking Number Required for Product Shipments

When you ship your products to our studio, you are responsible for providing the tracking number to us, either by phone or email, on the day of the shipment. This allows us to track the package, ensure that it is delivered to our office correctly, and schedule the processing of your order appropriately. Please note that our studio is currently located in a multi-tenant office building where packages for all tenants are received at the front desk and are not always routed correctly to each tenant. We are not immediately informed every time a package is received.

If you fail to provide us with the tracking number, we cannot guarantee the quoted delivery time and we are not responsible for lost packages.

Damage to Products in Transit

We are not responsible for damage to products in transit. You are responsible for ensuring that your products are packed appropriately and that appropriate arrangements are made with the carrier.

Product Return Requires Special Arrangements

We do not normally return products to the client after shooting, except for high-value items that are worth more than the cost of return shipping, re-packaging and re-stocking. During the shooting process, products are routinely altered as necessary to achieve certain visual effects and appearance. These alterations will render the product unable to be sold and/or consumed:

  • Bottles will have the rear portion of the label cut off and/or removed to allow the back light to illuminate the liquid fully.
  • Consumable products will have plastic wrap removed.
  • Caps/lids/spouts may be loosened and rotated into a different orientation.
  • Fluid levels may be adjusted by adding water, oil, glycerine or other substances depending on the type of product, or removing fluid to match the fill levels in other product variations.
  • Substances such as modeling clay may be used to prop up the product and may leave a residue on the product.
  • Boxes may be opened and filled with props to straighten the sides. Tape and glue may be used for straightening.

The client should expect the product to be altered by these and other methods, and should not expect the product to be returned in a condition that is suitable for resale, unless alternative arrangements are made.

If you require the product to be returned, please do the following:

  • Discuss your requirements with us before shipment. In what condition must the product be retuned? What parts of the packaging must be left intact? Do you need the product to remain unopened?
  • Pay the return shipping cost. We can either provide you with a quote, or you can schedule and pay for the pickup using your account.

License / Authorization to Use Images

Once your order has been paid in full, you are fully authorized to use, share, and/or publish the delivered images in any form of media.

If your order is refunded, or if you request a chargeback for a credit card payment, you are not authorized to use any images that may have been delivered on that order, and any previously granted license is revoked.

Publication of Images by KWR Studio

Any image delivered to you by KWR Studio, and accepted and published by your organization, is considered fit for publishing by KWR in any form of media unless the client requests that the images are kept private.

Quality Guarantee / Refund Policy

If you are not satisfied with the quality of the images we deliver, and you have not yet used, published, or shared the images for any purpose other than internal review (within your organization) you have the option of a full refund. Refund must be requested within 1 week of photo delivery. We may also offer to adjust or re-shoot the images as an alternative to the refund, which you may accept or decline.

To reiterate: If you publish or share the images in any form of media (website, social media, email, private message to customers, etc.) to anyone outside of your organization, this establishes that the quality of the images is acceptable and you have forfeited your right to a refund under our quality guarantee. For example: If one of your sales reps sends the photos to a customer, we consider the images to have been used (to help sell your product) and will not issue a refund in this case.

Client agrees to pay for all legal expenses incurred by KWR Studio in the event of a dispute over a refunded order.

Delivery Guarantee / Refund Policy

If we are unable to deliver the images within the agreed upon timeframe, you have the option of canceling your order for a full refund. You also have the option of downgrading your order to a lower delivery speed and receive a partial refund for the difference.

Delivery schedule:

  • "Next Day" means photos will be delivered on the day after we receive your product shipment (Pacific Time). For example, if we receive your product at 10:00am on Monday, we will deliver your photos on or before the following Tuesday, by 11:59pm Pacific Time.
  • "3 Days" means photos will be delivered on the third day after we receive your product shipment (Pacific Time). For example, if we receive your product at 10:00am on Monday, we will deliver your photos on or before the following Thursday, by 11:59pm Pacific Time.
  • "5 Days" means photos will be delivered on the fifth day after we receive your product shipment (Pacific Time). For example, if we receive your product at 10:00am on Monday, we will deliver your photos on or before the following Saturday, by 11:59pm Pacific Time.

If you cancel your order for a refund after delivery, you are not authorized to use, share of publish the images that were delivered.

No Other Refunds

We do not allow cancellation or refunds for any reason other than those described above (quality and delivery issues) and legitimate billing disputes (accounting errors/mistakes).

Billing Disputes and Chargebacks

If you have a question about a transaction or would like to open a billing dispute, please contact us at support@keepitreal.studio.

Requesting a chargeback on a valid (authorized) transaction is not an acceptable means of obtaining a refund. Please contact us to resolve any billing disputes or refund requests prior to initiating a chargeback request.

Liability Waiver

KWR Studio assumes no liability for damages due to the client's publication of inaccurate product images. Upon photo delivery, you are responsible for inspecting all images to ensure that all of the details of your product are correctly represented before publishing them or sharing them outside your organization. For example: Make sure colors are accurate, information on the label is accurate, packaging is current and accurately represents that which will ship to your customer. Ensure that all visual aspects of the product depicted are acceptable to your organization and approved for publication before sharing with customers and/or any third parties.

KWR Studio assumes no liability for damages or disruption to your business due to late or delayed delivery of images.

Client agrees to pay all legal/attorney's fees incurred by KWR due to any dispute initiated by the client.
